II.    Legal Basis
1.    Article 97 of Chapter 12 of the Social Insurance Law of the People’s Republic of China:  "Foreign citizens employed in China shall participate in the social insurance  in accordance with the law."

III.    Requirements for Participation
1.    Foreign citizen employed in Chengdu administrative region means  a person who  is not of Chinese nationality, who holds employment certificates or residence permits for foreigners such as Employment License for Foreign Citizen, Foreign Expert Certificate or Resident Journalist Certificate, etc., who holds Alien Permanent Resident Certificate, and who is employed lawfully within the Chengdu  administrative region. Residents from Taiwan, Hong Kong, and Macao employed in Chengdu administrative region means a person who is of Chinese nationality, who holds Employment License for Residents from Taiwan, Hong Kong, and Macao and Mainland China Entry Permit for Taiwan Residents or Mainland China Entry Permit for Hong Kong and Macao Residents, and who is employed lawfully within the Chengdu administrative region.
2.    Foreign citizens and residents of Taiwan, Hong Kong, and Macao employed by organizations  legally  registered  in   China   such   as   enterprises,   public institutions, social organizations, private non-enterprise entities, foundation, law firms, accounting firm, etc. (hereinafter referred to  as  Employer),  shall  participate  in  basic pension insurance  for employees,  basic  medical insurance  for employees,  work injury insurance, unemployment insurance, maternity insurance, and mutual supplementary medical insurance for serious illness. The insurance premium shall be paid by the Employer as well as the employees themselves pursuant to related regulations.
3.    Foreign citizens and residents of Taiwan, Hong Kong, and Macao that have signed employment contract with foreign employers and dispatched to branches and representative offices registered in China (hereinafter referred to  as  Chinese  Working Unit), shall participate in basic pension insurance for employees, basic medical insurance  for  employees, work  injury  insurance,   unemployment insurance, maternity insurance, and mutual supplementary
 medical insurance for serious illness. The insurance premium shall be paid by the Chinese Working Unit as well as the employees themselves pursuant to related regulations.

IV.    Application Materials
1.    Chengdu Social Insurance Increase of Participation Listing (in duplicate with organization’s official seal).
2.    Foreign  citizen  shall  provide: Foreigner  Permanent  Residence  Certificate  or Employment License for Foreign Citizens or Foreign Expert Certificate or Resident Journalist Certificate as well as valid passport. All application materials require originals and copies.
3.    Residents from Taiwan,   Hong Kong,   and Macao shall provide: valid Mainland China Entry Permit for Taiwan Residents  or  Mainland China  Entry  Permit  for Hong Kong and Macao Residents, as well as Employment License for Residents from Taiwan, Hong Kong, and Macao. All application materials require originals and copies.

V.    Application Procedures
1.    Upon the employment of foreign citizens or  residents  from  Taiwan,  Hong  Kong, and Macao, the Employer (or Chinese Working Unit) shall fill in the Chengdu Social Insurance Increase of Participation Listing at the related service window for social  insurance  agencies  of  district/county/city  according  to  territorial jurisdiction, and submit the relevant application materials within thirty (30) days from the date applying for their Employment License.
2.    The related service window for social insurance agencies of district/county/ city shall be responsible for examining and verifying the submitted application materials, processing     the     application     materials      that      fulfill      requirements,  entering the basic information of participator  to  generate the  personal social insurance ID number, printing cash/check receipt or bank advice for collection, signing the Chengdu Social Insurance Increase of Participation Listing and retaining  to be archived with   copies of other relevant application materials.
 3.    Where relevant requirements are not conformed, insurance participation application will not be accepted, and the Employer (or Chinese Working Unit) shall  be informed, within the original processing time requirement, about application materials to be added or revised and the specific future application processing time.
4.    After helping their foreign, Taiwanese, Hong Kong or Macao employees enroll in social insurance program, Employers (or Chinese Working Units) shall pay all social insurance premiums in full amount as specified in relevant laws and regulations from the month the social insurance participation application is accepted, the part of premiums that shall be borne by employees shall be deducted from the salaries of employees.

VI.    Remarks
1.    Employers (or Chinese Working Units) shall complete relevant forms with genuine information in accordance with relevant provisions under Social Insurance Law of the People's Republic of China.
2.    China has entered into Bilateral Social Insurance Agreement with Germany and South Korea, subject to which, German employee in  mainland  China  with  Insurance Participation Certificate specified under Bilateral Social Insurance Agreement may choose not to participate in basic pension insurance and unemployment insurance  in  mainland  China;  South  Korean  employee  in  mainland  China  with  Insurance  Participation   Certificate   specified   under Bilateral Social Insurance Agreement may choose not  to  participate  in  basic  pension insurance  but  shall  participate  in  all  other  insurances  in  mainland  China. German and South Korean employee without Insurance Participation Certificate specified under Bilateral Social Insurance Agreement shall participate in all insurances for employees of mainland China.
3.    Service windows of social insurance agencies of district/county/city will process applications from the 5th to 25th of every month.
