Chengdu Administration of Foreign Expert Affairs

1.Legal basis

⑴Decision about instituting administration permission to necessarily remain administrative examination and approval items by State Council (Decree No. 412 of the State Council of the People’s Republic of China in 2004) Article 443 “Foreign Expert Working Permit”.

⑵Notification about Issuing ‘Provisions of Foreign Expert Working Permit Application’ by State Administration of Foreign Expert Affairs (No 139, in 2004), Article 3: Foreign experts shall obtain Foreign Expert Working Permit for the purpose of employment within the territory of P.R. Article 5: In the case that ministries or commissions under the State Council, agencies and non-profit-making institutions directly affiliated to the State Council, or
specialized companies employ foreign experts, application shall be made with State Administration of Foreign Experts Affairs; in the case that other companies or institutions employ foreign experts, application shall be made with provincial administrations of foreign experts affairs by the principle of territorial management.

⑶Notification about doing a good job at downing the third batch of administrative examination and approval items by Sichuan Provincial Human Resource and Social Security Department (No.10 letter of Sichuan Provincial Human Resource and Social Security Department)

2.    Basic requirements

Foreign experts who apply for Foreign Expert Working Permit shall abide by Chinese laws and regulations, be in good health and have clean criminal records.

3.    Qualifications

⑴Foreign cultural and educational professionals

Foreign professionals who are employed to work in Chengdu in relation to education, scientific research, press and publication, culture, arts, public health and sports, shall hold a bachelor’s degree or higher degrees and have at least 5-year work experience in related jobs (language teachers shall be native speaker under 65 years old, hold a bachelor’s degree or higher degrees and have at least 2-year work experience but less than 5 consecutive years working in China ; doctors shall hold Foreign Doctor Working Permit issued by Department of Health; athletes shall hold certificate issued by related association.)

⑵Foreign technical and managerial professionals includes:

① High-ranking foreign technical or managerial professionals who are employed to take up position above vice general manager or enjoy equivalent treatment in enterprises in Chengdu, who shall hold a bachelor’s degree or higher degrees and have at least 5-year work experience in related jobs.
 
②Foreign professionals who are employed to work in Chengdu for the purpose of executing inter-governmental, inter-organizational agreements, protocols, or China-foreign trade contracts

③Foreign resident representatives in Chengdu of foreign experts organizations or foreign talent agencies approved by SAFEA (State Administration of Foreign Expert Affairs)

④Foreign technical and managerial professionals with extraordinary expertise of which China is in urgent need, who are employed to work in Chengdu in the fields of economy, technology, engineering, trade, finance and accounting, taxation and tourism (pre-condition for approval of special industry: pilot shall hold the Pilot License issued by administration of civil aviation.)

4.    Procedure

⑴ Employers register online

Employers that intend to employ foreign experts for the first time are required to login Foreign Experts Work Certificate Management System on SAFEA website, provide their basic information according to the system, then submit the registration application online and materials listed below to Chengdu Administration of Foreign Affairs within 15 days after registration:

① Employer registration application form (with official seal)

② Employers who intend to employ educational and training experts shall submit Qualification Certification and Qualification Certificate for Employing
 
Foreign Experts or Reply to Qualification Certificate for Employing Foreign Experts issued by Chengdu Administration of Foreign Expert Affairs; other employers shall submit the duplicate of Organization code, duplicate of Business license, Institution legal person certificate or Foreign enterprise resident representative office registration certificate (The originals will be checked, the copies shall be submitted.).
After getting the approval of Chengdu Administration of Foreign Expert Affairs, employers can apply for the Foreign Expert Working Permit online. The overdue submission of documents required will lead to the cancellation of the application online.

Processing time: usually 5 working days if documents are complete (from the time of documents acceptance)

⑵Foreign Expert Certificate handling

①Employers login Foreign Experts Work Certificate Management System on SAFEA website, provide their basic information according to the system, after confirmation save those information and submit the application online, the system will automatically create a Working Permit application number.

②When pass the initial examination online, the application status will turn to “pass the initial examination”. Then the staff of employer’s expert management department submits application materials required by the initial examination online to Chengdu Administration of Foreign Expert Affairs. If materials are complete, application will be accepted and processed. In the case of incomplete application materials or any inconformity with the required materials, the implementing authority shall inform the applicant of all the materials to be supplemented and mistakes to be corrected on the spot or within 5 days.

③After the application is approved, Chengdu Administration of Foreign

Expert Affairs issues the Foreign Expert Certificate to the applicant. The commissioner can pick up it on Chengdu Administration of Foreign Experts Affairs when the web system shows that it is ready to be collected.

Processing time: usually 5 working days for initial examination online, another 5 working days for materials examination (from the time of materials acceptance)

5.    Application materials

⑴ Application statement : Using papers with employers title; clearly state the online application number; applicants and family members’ name, nationality, passport number; applicants’ intended job title, job responsibilities, job period, with employers’ seal.

(3)    Foreign Expert Working Permit application stub/receipt

For foreign technical and managerial experts without Foreign Expert Working Permit, CV of applicant with employer’s official seal (including educational background and work experience), credentials of highest education qualification or professional qualifications (the original will be checked, the copy shall be submitted)

⑶ Health certificate issued or verified by a health and quarantine department arranged by the Chinese government

⑷A copy of the Agreement or Contract,Letter of Appointment or Letter of Assignment(the original will be checked, the copy shall be submitted)

⑸ Copies of Passport (including all the pages which contains visas or stamps) or Resident permit (the original will be checked, the copy shall be submitted)

⑹ One two-inch (35mm*49mm) clear ID photo of applicant with white background, and from the front without any head-coverings

⑺For any family member accompanying the applicant in China, copies of Passport (including all the pages which contains visas or stamps) or Resident permit (the original will be checked, the copy shall be submitted) and one two-inch (35mm*49mm) clear ID photos of the family member with white background and from the front without any head-coverings. For spouse, copies of Marriage certificate and Health documents; for children under 18 years old, copies of Birth certificate (Children aged above 18 years old don’t belong to accompanying family members.)

⑻ Copy of valid Qualification Certificate for Employing Foreign Experts (necessary if employers intend to employ educational and training experts); copies of Business license (duplicate) and Organization code (duplicate) (necessary for other employers).

⑼Original recommendation letter of the former employer if the cultural and educational experts work for another employer in China before (template can be downloaded from official website of Chengdu Administration of Foreign Experts Affairs); for technical and managerial experts, Employment separation certificate or certification of cancellation of old certificates

⑽Copy of ID card of the staff of employer’s expert management department.⑾Selected experts of China’s “1000 Plan”, Sichuan Provincial “1000 Plan” and “Chengdu Talents Plan”, winners of the state-level, provincial or municipal “Friendship Award”, and foreign experts employed by national-level or Chengdu municipal-level exemplary bases (units) of foreign expects recruitment may enjoy the “Green Channel” benefits by showing relevant certificates or documents.

Note: the materials in foreign language shall be translated by professional translation agency. And the translation shall be sealed. All materials shall have one copy.
